These Terms & Conditions (“Terms”) govern your access to and use of the services, website, booking system, and virtual reality experiences provided by Game Over VRCADE, Ltd. (doing business as “Game Over VRCADE”) (“we,” “our,” or “us”). By visiting our website, booking a session, or using our services, you agree to these Terms.

 

1. Booking & Payment

• All bookings must be completed through our website, Wix Bookings, or in store.

• Payments are processed securely through Square or Wix’s integrated payment system.

• We reserve the right to refuse service to anyone for any reason.

2. Session Requirements

​

Guests must:

 

• Follow all staff instructions at all times.

• Wear required VR safety gear.

• Use equipment responsibly.

• Immediately report discomfort, nausea, dizziness, or hardware issues.

 

 

Failure to follow safety rules may result in immediate removal without refund.

3. Health & Safety Warning

​

VR experiences may cause:

 

• Motion sickness

• Eye strain

• Dizziness or imbalance

• Disorientation

• Nausea

• Rapid heartbeat

 

 

Guests participate at their own risk. If you have epilepsy, heart conditions, recent injuries, pregnancy, severe motion sickness, or other health issues, consult a doctor before participating.

4. Equipment Damage

​

Guests are responsible for the cost of repair or replacement if equipment is damaged due to:

 

• Intentional misuse

• Unsafe behavior

• Failure to follow staff instructions

​

Normal wear-and-tear damage is excluded.

​

5. Age Requirements

​

• Children under 13 must be supervised by a parent or legal guardian.

• Some VR experiences may have age restrictions depending on game content.

6. Behavior & Conduct

​

We maintain a zero-tolerance policy for:

 

• Violence or threats

• Harassment

• Disrespect toward other guests or staff

• Destruction of property

• Unsafe or reckless behavior

​

Guests violating these rules may be removed without refund.

​

7. Website Use

​

By using our website, you agree not to:

 

• Attempt unauthorized access

• Disrupt the website or booking system

• Upload harmful code or interfere with website operations

​

All website content, designs, graphics, and branding belong to Game Over VRCADE, Ltd.

​

8. Changes to Terms

​

We may modify these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date.

2. REFUND & CANCELLATION POLICY

At Game Over VRCADE, we aim to provide a fun and reliable VR experience. This policy outlines how refunds, cancellations, and rescheduling are handled.

1. Cancellations by Guests

​

• Done at our sole discretion.

​

2. No-Shows

​

If you do not arrive for your scheduled session and do not contact us:

•  No refund will be issued until asked by the guest.

• You may request to reschedule if space is available but not guaranteed.

​

3. Rescheduling

​

Guests may reschedule by contacting us:

• gameovervrcade@gmail.com

• Or through the booking system (if available)

 

Rescheduling within 24 hours is subject to availability only.

​

4. Late Arrivals

​

Sessions begin at the scheduled time.

Late arrivals may lose time from their session.

We cannot extend session time due to other bookings.

​

5. Refunds Due to Technical Issues

​

If we experience:

 

• Power outages

• Internet failure

• Equipment malfunction

​

… and cannot start your session, we will provide:

 

•  A full refund or

•  A free rescheduled session

​

6. Refunds for Behavior-Related Removal

​

Guests removed for violating safety rules or terms of service are not eligible for refunds.

​

7. Payment Disputes

​

Chargebacks made through Square or your bank may result in suspension of booking privileges until resolved.

 

3. LIABILITY WAIVER & RELEASE OF CLAIMS

By participating in VR activities at Game Over VRCADE, Ltd., you acknowledge and agree to the following:

1. Assumption of Risk

​

Virtual Reality (“VR”) experiences involve physical movement and may cause:

 

• Dizziness

• Motion sickness

• Loss of balance

• Collisions with objects

• Injury due to falls or loss of awareness

• Medical symptoms (heart rate changes, headaches, nausea)

​

By participating, you voluntarily assume all risks, whether known or unknown.

​

2. Fitness to Participate

​

You confirm that you:

 

• Are in good physical health

• Are not under the influence of drugs or alcohol

• Do not have medical conditions that would make VR unsafe (e.g., epilepsy, heart conditions, severe motion sickness)

​

If unsure, consult a medical professional before participating.

​

3. Release of Liability

​

You hereby release and hold harmless:

 

Game Over VRCADE, Ltd., its owners, employees, agents, contractors, and affiliates from all claims, liabilities, damages, or injuries resulting from participation in VR activities.

 

This includes injuries caused by:

 

• Loss of balance

• Misuse of equipment

• Collisions

• Falls

• Hardware malfunction

• Actions of other participants

This release applies to personal injury, property damage, and any related losses.

​

4. Indemnification

​

You agree to indemnify and defend Game Over VRCADE from claims arising from your actions or misuse of equipment.

​

5. Photo & Video Waiver

​

You consent to the use of photos or videos taken of your participation unless you opt out in writing.

​

6. If Signing for a Minor

​

Parents/guardians agree that:

 

• They accept all risks on behalf of the minor

• They release Game Over VRCADE from all liability

• They will supervise the minor as required

7. Agreement

​

By booking or participating, you acknowledge that:

 

• You have read this waiver

•  You fully understand it

•  You voluntarily agree to it

​

4. PHOTO / VIDEO PERMISSION CLAUSE

​

When booking or participating in activities at Game Over VRCADE, you acknowledge and agree that:

 

• Photos and videos may be taken for promotional purposes

• Images may appear on our website, social media, or marketing materials

• No compensation will be provided for use of these images

​

If you prefer not to be photographed or recorded:

 

Email us at gameovervrcade@gmail.com or inform a staff member before your session.

 

We will make every reasonable effort to avoid capturing your image.

 

5. MINORS PARTICIPATION POLICY

To maintain safety for our younger participants:

​

1. Children under 13

​

• Must be accompanied by a parent or legal guardian at all times

• Guardian must remain inside the arcade during the session

• Some experiences may not be suitable for children (based on game content)

​

2. Ages 13–17

​

• May participate without parent physically present

• Parent/guardian must sign the Liability Waiver

• Contact information must be provided

​

3. Unsupervised minors

​

Under no circumstances may a minor be dropped off at the arcade without a guardian responsible.

​

4. Behavior Expectations

​

Parents/guardians are responsible for the conduct of minors.

Failure to follow rules may result in removal without refund.
